What is a trademark?
As defined by the United States Patent and Trademark Office, a trademark is a word, phrase, symbol, and/or design that identifies and distinguishes the source of the goods of one party from those of others. A service mark is a word, phrase, symbol, and/or design that identifies and distinguishes the source of a service rather than goods. Some examples include brand names, slogans, and logos. The term "trademark" is often used in a general sense to refer to both trademarks and service marks.  

Unlike patents and copyrights, trademarks do not expire after a set term of years. Trademark rights come from actual “use” . Therefore, a trademark can last forever - so long as you continue to use the mark in commerce to indicate the source of goods and services. A trademark registration can also last forever as long as you continue to file the required documents and fees.

Why should I register my trademark?
Although federal registration of a mark is not mandatory, it has several advantages, including notice to the public of the registrant's claim of ownership of the mark, legal presumption of ownership nationwide, and exclusive right to use the mark on or in connection with the goods/services listed in the registration. Trademark Process Timeline
USPTO reviews the application: 4 - 6 months
Responding to the Office Action (unless there are no issues): 6 months
Publication period in the Official Gazette: 3 months
USPTO issues the certificate of registration: 2 - 3 months
Total: Typically 13 - 18 Months

Total Cost to File a Trademark
If your mark is in use at the time of the trademark filing, your total cost of registering a trademark will be the flat legal fee of $1,199 plus the US Government filing fee of $350 per class.
